NOTICE OF PROPOSED WATER POLLUTION CONTROL PERMITS
FOR THE HC&D SAND ISLAND FACILITY

The State Department of Health (DOH) tentatively proposes to issue a National Pollutant Discharge Elimination System (NPDES) permit to discharge sump overflow and storm water runoff from the HC&D Sand Island Facility, to receiving State waters, subject to special conditions to:

The proposed NPDES permit for the new discharges will expire five (5) years from the date of issuance.

HC&D, LLC operates the Facility, located off of Sand Island Access Road, Honolulu, Island of Oahu, Hawaii. The Facility is involved in manufacturing ready mix concrete. The wastewater generated by the Facility consists of water from the periodic wash down of the Facility’s trucks and foundation slab area, and storm water runoff. The area is graded to collect process wastewater and storm water into a sump. Under normal conditions, all process wastewater and storm water are recycled and used throughout the Facility (used for truck wash, dust control, and concrete production). In the event of a heavy rainfall, however, the sumps that normally collect all process wastewater and storm water may overflow. If an overflow occurs, the discharge will enter Keehi Lagoon through Outfall Serial No. 001 located at coordinates: Latitude 21 19’36"N and Longitude 157 53’35"W.

The Permittee’s operations also include an unpaved area at Pier 60 to unload barges containing sand or aggregate. The site is graded such that storm water flows away from the pier dock and generally infiltrates into the ground. If a discharge occurs, the discharge will enter Keehi Lagoon through Outfall Serial No. 002 located at coordinates: Latitude 21 19’22"N and Longitude 157 53’37"W. The permit renewal application, dated January 18, 2018, specified that Outfall Serial No. 002 has been relocated from the previous permit to accurately reflect the path of storm water discharge from the unpaved area at Pier 60 into Keehi Lagoon. There has not been a reported discharge from the Facility during the last permit term.

The receiving water, Keehi Lagoon is designated as “Class A, Marine Water, Embayment” under Section 11-54-3(c)(2), Hawaii Administrative Rules (HAR). It is the objective of Class A waters that their use for recreational purposes and aesthetic enjoyment be protected. Any other use shall be permitted as long as it is compatible with the protection and propagation of fish, shellfish, and wildlife, and with recreation in and on these waters. These waters shall not act as receiving waters for any discharge which has not received the best degree of treatment or control compatible with the criteria established for this class. No new sewage discharges will be permitted within embayments. No new industrial discharges shall be permitted within embayments, with the exception of storm water discharges associated with industrial activities (defined in 40 CFR sections 122.26(b)(14) and (b)(15), except (b)(15)(i)(A) and (b)(15)(i)(B)) which meet, at the minimum, the basic water quality criteria applicable to all waters as specified in section 11-54-4, and all applicable requirements specified in the Chapter 11-55, titled “Water Pollution Control”.

Persons wishing to comment upon or object to the proposed NPDES permits or to request a public hearing, should submit their comments or requests in writing no later than 30 calendar days after the date of this notice, either through e mail at: cleanwaterbranch@doh.hawaii.gov or by mail at P.O. for public inspection, Monday through Friday (excluding holidays) from 7:45 a.m. until 4:15 p.m., at the DOH, Clean Water Branch (CWB) office located at the 2827 Waimano Home Road #225, Pearl City, HI 96782. All written comments and requests received on time will be considered. If the DOH determines that there is significant public interest, a public hearing may be held after at least 30 calendar days of public notice.

If DOH’s position is substantially unchanged after considering all timely written comments and all oral comments at any public hearing that may be held, then the DOH will issue the NPDES permit and this action will be final.
