NOTICE OF PROPOSED WATER POLLUTION CONTROL PERMIT
FOR MARISCO, LTD.
KAPOLEI, ISLAND OF OAHU

The State Department of Health (DOH) tentatively proposes to issue a National Pollutant Discharge Elimination System (NPDES) permit to discharge drydock evolution water, non contact cooling water, and storm water runoff to receiving State waters, subject to special conditions to:

MARISCO, LTD.

The proposed NPDES permit for the existing discharge will expire five (5) years from the date of issuance.

Marisco, Ltd. operates three floating drydocks at their facility located at 91-967 Malakole Street at the Barbers Point Harbor, Campbell Industrial Park, Kapolei, island of Oahu, Hawaii. The facility engages in the repair of government and commercial ships using floating drydocks and land-based maintenance shops. Activities conducted at the facility include sandblasting with copper slag, repainting with anti-fouling paint, and hull, electrical and mechanical repairs. The facility consists of two non-contiguous shoreline areas, each with shoreside facilities and floating drydocks, within Barbers Point Harbor. The floating drydocks are equipped with ballast tanks that can be flooded with harbor water to lower the platform to dock and undock vessels and pumped out to raise the platform. The drydock deck must be kept clean and washed prior to its lowering into the harbor. Wash water is prohibited from being discharged into the harbor.

There are 10 outfalls within the facility to discharge drydock evolution water associated with the lowering and lifting of the drydock, non contact cooling water from docked vessels and storm water runoff into Barbers Point Harbor. The locations of the outfalls are listed in the permit application and draft permit.

The Barbers Point Harbor is classified by the DOH as a Class A, Dry, Embayment under Hawaii Administrative Rules (HAR) 11 54-6(a)(2)(B). It is the objective of Class A waters that their use for recreational purposes and aesthetic enjoyment be protected. Any other use shall be permitted as long as it is compatible with the protection and propagation of fish, shellfish, and wildlife, and with recreation in and on these waters. HAR 11-54-3(c)(2)(A) authorizes non contact thermal and drydock discharges into the Barbers Point Harbor.

Persons wishing to comment upon or object to the draft NPDES permit or to request a public hearing, should submit their comments or requests in writing no later than 30 calendar days after the date of this notice, either through e-mail at: cleanwaterbranch@doh.hawaii.gov or by mail at 2827 Waimano Home Road, Room 225, Pearl City, Hawaii 96782.

Copies of the draft permit and other information are available for public inspection, Monday through Friday (excluding holidays) from 7:45 a.m. until 4:15 p.m., at the DOH Clean Water Branch (CWB) office located at the 2827 Waimano Home Road 225, Pearl City, Hawaii 96782. All written comments and requests received on time will be considered. If DOH determines that there is significant public interest, a public hearing may be held after at least 30 calendar days of public notice.

If DOH’s position is substantially unchanged after considering all timely written comments and all oral comments at any public hearing that may be held, then the DOH will issue the NPDES permit and this action will be final.
