NOTICE OF APPLICATION FOR VARIANCE
RECEIVED BY THE DEPARTMENT OF HEALTH
STATE OF HAWAII

KAKAAKO AND PUNAHOU AREA SEWER RECONSTRUCTION
SEWER I/I ALA MOANA BASIN

Community Noise Control Variance Application No. V-1108
(Docket No. 19-NR-VN-28)

Pursuant to Chapter 342F-5, subsection (h), Hawaii Revised Statutes, the Department seeks written comments from interested persons regarding the following variance application:

The City and County of Honolulu, Department of Environmental Services (ENV), 650 South King Street, Honolulu, Hawaii, 96813, has applied to the Department of Health for a noise variance from Hawaii Administrative Rules (HAR), Chapter 11-46-6(a), which states, “General Prohibition. Without a permit or variance issued pursuant to section 11-46-7 or 11-46-8, no person within the State shall operate, from any premises or land owned, rented, leased, occupied, or controlled by that person, any excessive noise source.”

ENV proposes to undertake the Kakaako and Punahou Area Sewer Reconstruction, Sewer I/I Ala Moana Basin project in Kakaako, Oahu, Hawaii to rehabilitate the existing sewer located on Punchbowl Street at the intersection of Queen Street to facilitate maintenance of the sewer system and protect the public’s health and safety by preventing future sewer spills and backups. Project work will include excavation and pipe removal, pipe installation, CIPP liner installation, and the re alignment of an existing manhole frame and cover. To minimize sewage spills and ensure the safety of the public and construction personnel, ENV plans to bypass the sewer line continuously, for 24 hours, 7 days a week during construction. The sewer bypass will require the use of pumps and generators being run periodically for 24 hours, 7 days a week. Overnight work may also be needed for the CIPP liner installation.

The period of construction requested for coverage, pursuant to HAR § 11-46-7(J)
(1-3) includes the following:

Mondays through Fridays: Midnight to 7:00 a.m. and from 6:00 p.m. to
midnight.
Saturdays: Midnight to 9:00 a.m. and from 6:00 p.m. to midnight.
Sundays and holidays: Midnight to midnight.

Construction activities are anticipated to commence in October 2019 and last 6 months.

The Department of Health will retain and consider all written comments received not later than thirty (30) days after the date of this notice, on the variance application. The final decision will be made on the basis of the application, related documents, written comments, and the public hearing, if any.
