NOTICE OF PROPOSED
SECTION 401 WATER QUALITY CERTIFICATION

The Hawaii State Department of Health (DOH) proposes to issue a Section 401 Water Quality Certification (WQC), which includes conditions and requirements, to Castle & Cooke Homes Hawaii, Inc. for the application of the Department of the Army (DA) permit under DA File No. POH-2016-00132 to be issued under the authorization of Section 404 of the Clean Water Act (CWA, 33 U.S.C. 1344 and 2017 Nationwide Permit 13 for the "Koa Ridge Development – Koa Ridge Offsite Detention Basin (OSDB) & Koa Ridge Offsite Drain Line No. 1 (DL 1)" project.

CCHH is proposing construction of an offsite detention basin to mitigate the increase of the peak stormwater discharge into Kipapa Stream from the development of Koa Ridge Makai. CCHH is also proposing construction of a 1,070-foot-long drain line to convey stormwater runoff from the southern portion of the Koa Ridge development to Kipapa Stream.

Best Management Practices (BMPs) measures are proposed to ensure that the proposed construction activities associated with this project will not adversely impact the water quality of Kipapa Stream. An Applicable Monitoring and Assessment Plan (AMAP) is also prepared to verify/ensure the adequacy of the BMPs measures implemented.

The receiving State water, Kipapa Stream, located on the Island of Oahu, is classified by the DOH as a "Class 2, Inland Water" and is not listed in the "2014 STATE OF HAWAII WATER QUALITY MONITORING AND ASSESSMENT REPORT."

Based on an evaluation of the Section 401 WQC Application, the supporting information, which are relevant to water quality considerations, and when all requirements and conditions contained in this proposed Section 401 WQC are fully complied with, there is reasonable assurance that the discharges resulting from the proposed construction activities will be conducted in a manner which will not violate the applicable water quality standards (WQS) and will comply with the applicable provisions of CWA, Sections 301, 302, 303, 306, and 307.

The proposed Section 401 WQC shall become effective on the issuance date of the Section 401 WQC. This Section 401 WQC shall expire two (2) years from the issuance date of the Section 401 WQC, or the Total Maximum Daily Load (TMDL) Implementation Plan for Kipapa Stream is established by the DOH and approved by the U.S. Environmental Protection Agency (EPA), or until the applicable WQS are revised or modified, or DA 2017 NWP 13 (File No. POH-2016-00132) is modified, revoked, suspended, or expired, or when the project related construction activities are completed, whichever is earlier. If the applicable WQS is revised or modified, before the proposed expiration date, and such that the activity complies with the revisions or modifications to the WQS, the determination of waiving the notification requirements shall continue to be valid until the Section 401 WQC expires.

Persons wishing to comment upon or object to the proposed determinations or request a public hearing should submit their comments or request in writing no later than 30 calendar days from the date of this notice either in person or by mail, to:

All written comments and requests received on time will be considered. If the DOH determines that there is significant public interest, a public hearing may be held after at least 30 calendar days of public notice.

If the DOH’s position is substantially unchanged, after considering all timely written comments and all oral comments at any public hearing that may be held, the DOH will issue or deny the Section 401 WQC, as appropriate, and this action will be final.
