WASTEWATER SYSTEMS PUBLIC NOTICE OF VARIANCE APPLICATION NO. WW 483 DOCKET NO. 17 – VWW – 35 Pursuant to Hawaii Revised Statutes (HRS) Section 342D-7(i), the State Department of Health (DOH) seeks written comments from interested persons regarding the following. Mr. Jonathan Starr, President, Starr Equities, Inc., c/o SVN/ Clark Commercial Group, has applied for a variance for the maximum of five (5) years as stated in the variance application from Hawaii Administrative Rules (HAR) section 11-62-31.1(a)(2)(D). Mr. Theodore Baldau, President, Tropical Marine Environment, Inc. is the authorized agent to act for this applicant. This is a renewal of WW 231 for a commercial building with a single individual wastewater system (IWS) which may have a total daily wastewater flow greater than 1,000 gallons per day (gpd). The Starr Equities, Inc. property is located at 64-1067 Mamalahoa Highway, Kamuela, Hawaii 96743, TMK (3) 6-4-006: 004, 44,720 square feet. The existing large capacity cesspool(s) has been converted and replaced with a new treatment individual wastewater system to comply with federal requirements. The owner of the facility simply cannot afford to build and operate wastewater systems (such as small aerobic wastewater treatment plants) to meet all the requirements of HAR Chapter 11-62.
