AMENDED SUMMONS IN A CIVIL CASE AND NOTICE OF COMPLAINT

YOU ARE HEREBY NOTIFIED that Plaintiffs Quikrete Holdings, Inc. and Continental Casualty Company ("Plaintiffs") have commenced an action by way of Complaint in Civil No. CV-24-00515 HG-WRP in the United States District Court for the District of Hawaii, seeking a declaratory judgment pursuant to 28 U.S.C. § 1391 that Plaintiffs have no duty to defend or indemnify you for any of the claims asserted against you in Jeremiah, et al., v. Deer, et al. , Civ. No. 1CCV-23-00001076 in the First Circuit Court, State of Hawaii pursuant to a certain contract of insurance issued to Quikrete Holdings, Inc. by Continental Casualty Company.
YOU ARE HEREBY SUMMONED to appear before the Honorable Wes Reber Porter on June 26, 2025 at 9:00 a.m. OR to file an Answer or other responsive pleading at the United States District Court for the District of Hawaii by June 20, 2025 and serve a copy on Plaintiffs’ counsel: Wesley H. H. Ching, whose address is Fukunaga, Matayoshi, Ching & Kon-Herrera, 841 Bishop Street, Suite 1200, Davies Pacific Center, Honolulu, Hawaii 96813. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint.
