SUMMONS

To: Bank of Honolulu, National Association, and

All unknown persons claiming any interest in the “Second Mortgage” recorded in the Bureau of Conveyances on May 17, 1979, LIBER 13691, page 676, which encumbers the real property located at 3731 Kanaina Avenue, Unit 232, Honolulu, Hawaii 96815, Tax Map Key No. (1) 3-15-13-5.

YOU ARE HEREBY NOTIFIED THAT Plaintiffs Heidi H. Cheron and Emmanuel J. Cheron have commenced a quiet title action against you in Civil No. 1CCV-25-0000065 in the Circuit Court of the First Circuit, State of Hawaii, by filing a “First Amended Complaint for Release of Mortgage Lien on Real Property and to Quiet Title,” on January 17, 2025, wherein Plaintiffs seek judgment (1) expunging, cancelling, or otherwise releasing that certain “Second Mortgage” in favor of Defendant Bank of Honolulu, National Association, which was recorded in the Bureau of Conveyances on May 17, 1979, LIBER 13691, page 676, and which encumbers the real property located at 3731 Kanaina Avenue, Unit 232, Honolulu, Hawaii 96815, Tax Map Key No. (1) 3-15-13-5, and (2) ratifying Rex Hadlich’s authority as Trustee of the “Shirley G. Magazin Revocable Trust Agreement” with respect to his execution of that certain “Quitclaim Apartment Deed” which was recorded in the Bureau of Conveyances on August 15, 2000, as Document No. 2011-112888.
YOU ARE HEREBY SUMMONED to appear before Honorable Shirley M. Kawamura, Judge of the above-entitled Court, in Courtroom 12, located on the fourth floor of Kaahumanu Hale, 777 Punchbowl Street, Honolulu, Hawaii 96813 on April 8, 2025 at 9:00 A.M., or to file an answer or other pleading and serve it before said day upon Frederick J. Arensmeyer, Esq., Plaintiffs’ attorney, whose address is 737 Bishop Street, Suite 2920, Honolulu, Hawaii 96813. If you fail to do so, judgment by default will be taken against you for the relief demanded in the aforesaid First Amended Complaint.
