LEONARD KEN LIM WONG AND MYRA GAIL WONG, CO-TRUSTEES OF THE WONG FAMILY REVOCABLE LIVING TRUST DATED AUGUST 18, 2007; and

YOU ARE HEREBY NOTIFIED that PLAINTIFFS DAYNA M. ONAGA; BRYAN K. WONG; BRADLEY K.L. WONG; GERALD K.S. WONG, SR., TRUSTEE OF THE REVOCABLE TRUST OF GERALD K.S. WONG, SR. DATED AUGUST 19, 2010; ALLEN K. F. WONG, TRUSTEE OF THE ALLEN KEN FONG WONG REVOCABLE LIVING TRUST DATED SEPTEMBER 3, 2009 (collectively, “Plaintiffs“) have filed a Complaint in Civil No. 1CCV-22-0000314, praying: (A) that the Court find that certain real property located at 47-730 Ahilama Place, Kaneohe, Hawaii 96744, identified as Tax Map Key No. (1) 4-7-043-049 (the “Property“), is “heirs property within the meaning of Hawaii Revised Statutes (“HRS“) § 668A-2; (B) that the Court appoint a Special Master pursuant to HRS § 668A-6; (C) that Process issue herein citing and summoning Defendants to appear and answer the Complaint as provided by law; (D) that the Court order Defendants to come forward and present for adjudication any and all purported claims they might allege in or relating to the Property; (E) that the Court declare and adjudge the respective interests of Plaintiffs and Defendants, and each of them, in and to the Property; (F) that the Court determine the fair market value of the Property by ordering an appraisal pursuant to HRS § 668A-7; (G) that in the event one or more Defendants do not elect to buy all of Plaintiffs’ interest in the Property pursuant to HRS § 668A-8, the Court order a partition of the Property by open-market sale pursuant to HRS § 668A-11; (H) that the Court grant Plaintiffs all other relief herein or subsequently requested; and (I) that the Court award Plaintiffs’ the costs and attorneys’ fees they incurred in preparing for and prosecuting this action including but not limited to those recoverable pursuant to HRS § 668-17 as provided by HRS § 668A-3(c), and such other and further relief deemed just and equitable by the Court.
YOU ARE HEREBY SUMMONED to appear before the 21st Division, the Honorable James C. McWhinnie in his courtroom in the Kaahumanu Hale, 777 Punchbowl Street, Honolulu, Hawai’i, on August 30, 2022, at 9:00 o’clock a.m., of said day or to file an answer or other pleading and serve it before said day upon Plaintiffs’ attorney, NAINOA J. WATSON and ANDREW J. LAUTENBACH of STARN O’TOOLE MARCUS & FISHER whose address is 733 Bishop Street, Suite 1900, Honolulu, Hawaii 96813. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint.
