If you are, or were: (1) an apartment owner or resident of the Marco Polo Apartment Building as of July 14, 2017; (2) a contractor or vendor working at the Marco Polo Apartment Building on or before July 14, 2017; or (3) a person or entity whose rights were, or may have been, affected by the Marco Polo Apartment Building fire on July 14, 2017 (e.g., a manufacturer, retailer, or insurer), a joint-scene examination will be conducted that may affect your rights. You may be allowed to participate in a joint-scene examination of the common elements/areas and apartments (and their limited appurtenant common elements) in the Marco Polo Building located at 2333 Kapiolani Blvd, Honolulu, HI 96826 (the "Marco Polo Building") beginning on October 23, 2017 and continuing until November 6, 2017, or as necessary to complete the examinations. Pursuant to the Stipulated Order entered in the lawsuit entitled Yuzo Komiyama, et al. v. Certified Management, et al., Civil No. 17-1-1333-08 DEO, all individuals or entities who were, or who may have been affected, by the July 14, 2017 fire at the Marco Polo Building (the "Fire"), are invited to apply to obtain authorization to participate in a joint-scene examination of the areas of the Marco Polo Building affected by the Fire. This notice summarizes the application process in order to participate in the joint-scene examination. Who can apply? Apartment owners or residents of the Marco Polo Building, as of July 14, 2017, may apply to attend the joint-scene examination. Contractors or vendors working at the Marco Polo Building on or before July 14, 2017 are also invited to apply. Finally, any other person or entity that believes he/she has or may have a claim resulting from the Fire at the Marco Polo Building is invited to apply to attend the joint-scene examination. Members of the general public and media are NOT invited to apply and may NOT attend the inspection. What is this inspection about? The joint-scene examination will provide all interested parties with the opportunity to inspect specified areas of the Marco Polo Building. The Marco Polo Association of Apartment Owners (the "Association") seeks to ensure that all individuals/entities with a right to bring a claim, or whose rights might be affected, have the opportunity to inspect those areas of the building before remediation and rebuilding begin. Do I have to attend the inspection? No. However, this may be the only opportunity to inspect the area where the Fire may have started and other areas affected by the Fire. Please note that a designated representative may appear on your behalf. How do I apply to attend the joint-scene examination?
