YOU ARE HEREBY NOTIFIED THAT Plaintiffs Kennedy M. Kumuhone, Loretta P. Pinero, Frederick A. Whitney, Lorita S. Whitney and Gary D. Pate have commenced an action against you in Civil No. 19-1-0570-04 (9th Div.) in the above-entitled Court seeking judgment against you in an amount to be detennined at trial; for reimbursement of costs and expenses, including reasonable provision for attorney’s fees; for prejudgment interest if applicable; for a declaratory judgment that the nonjudicial foreclosure sale of the property located at 87-1976 Pakeke Street, Apt. #N, Waianae, Hawaii 96792, Tax Map Key Number: (1) 8-7-010-022-0005 and subsequent transfer thereof to you is void and that Plaintiffs are the lawful record owners of the Property, by way of quiet title, estoppel, wrongful foreclosure, or otherwise; a judgment awarding title to and possession of the Property to Plaintiffs and quieting any claim of title or mortgage by any of the Defendants herein (other than the original mortgage given by Plaintiffs); for such other and further relief as the Court deems just and proper.
YOU ARE HEREBY SUMMONED to appear in the Courtroom of the Honorable Judge Lisa W. Cataldo, 1111 Alakea Street, Kauikeaouli Hale, Fifth Floor, Honolulu, Hawaii, on Tuesday the 19th day of May 2020, at 9 o’clock a.m. of said day, or to file an answer or other pleadings and serve it before said day upon Plaintiffs Kenney M. Kumuhone, Loretta P. Pinero, Frederick A. Whitney, Lorita S. Whitney and Gary D. Pate’s attorneys, Bickerton Law Group, LLLP, 745 Fort Street, Suite 801, Honolulu, Hawaii 96813. If you fail to do so, judgment by default may be taken against you for the relief demanded in the Complaint.
