YOU ARE HEREBY NOTIFIED that Plaintiff B-MUSED, LLC, a Texas Limited Liability Company, has commenced an action by filing a Complaint and an Amended Complaint in the First Circuit Court, State of Hawai`i, Civil No. 1CCV-25-0000459, in the matter entitled B-MUSED, LLC a Texas Limited Liability Company, Plaintiff, vs. THE HEIRS OR DEVISEES OF LORNA M.Y. FONG, TRUSTEE OF THE LORNA M.Y. FONG REVOCABLE LIVING TRUST UNDER AN UNRECORDED TRUST INSTRUMENT DATED SEPTEMBER 26, 2005; THE SUCCESSOR TRUSTEE OF THE LORNA M.Y. FONG REVOCABLE LIVING TRUST UNDER AN UNRECORDED TRUST INSTRUMENT DATED SEPTEMBER 26, 2005; SECRETARY OF HOUSING AND URBAN DEVELOPMENT; and DOE ENTITIES 1-20, Defendants, Civil No. 1CCV-25-0000459, wherein Plaintiff B-Mused LLC prays the Court grant foreclosure of the Property located at 2930A Kolomona Place, Honolulu, Hawaii, 96822, TMK No. (1) 1 2-9-038-050.306, that upon the foreclosure sale herein prayed for, all parties named in this action and all persons claiming any interest in the property, by through or under said Defendant, shall be forever barred and foreclosed of and from all right, title and interest and claims at law or in equity in and to the property, that this Court appoint a commissioner to take possession of the property, and that he/she be authorized to collect rents, deal with the property and to sell the same for cash, in lawful money of the United States of America, in the manner provided by law and by order of this Court, and upon the confirmation of said sale by this Court, that the commissioner be authorized and directed to make and deliver to the purchaser or purchasers such instruments of conveyance of the property as may be appropriate in the premises, free and clear of all liens, encumbrances and claims of creditors, to the same and that Plaintiff be awarded such other relief as may be appropriate in the circumstances.
YOU ARE HEREBY SUMMONED to appear in the courtroom of the Honorable JAMES H. ASHFORD, Judge of the First Circuit Court, 777 Punchbowl Street, Honolulu, Hawai`i 96813 on Tuesday, the 29th day of July, 2025 at 9:00 a.m., or to file an answer or other pleading with the Court and serve it before said day upon Plaintiff’s attorneys, Scott I. Batterman and Steven D. Mewha, whose address is Clay Iwamura Pulice & Nervell, 700 Bishop Street, Ste 2100, Honolulu, HI 96813. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint.
