TERMS OF SALE: No upset price, property sold
"as is" at public auction with 10% of highest bid payable in cash, money order, certified or cashier’s check at close of auction, balance payable in cash,
money order, certified or cashier’s check concurrently with the delivery of documents transferring title to the purchaser. 10% down payment may be forfeited if purchaser is unable to close transaction. Potential bidders must be able to provide proof of his ability to comply with 10% bid requirement prior to participating in public auction. Further bidding may be allowed at the confirmation hearing. Buyer shall pay all cost and expenses of closing including escrow conveyance and recordation fees, cost of preparation of conveyance documents, conveyance taxes, title insurance, and notary fees. The purchaser shall be responsible for securing possession of the property upon recordation. The commissioner may require that the sale be closed through escrow, with all costs being the responsibility of the purchaser.
