YOU ARE HEREBY NOTIFIED that Plaintiffs RODNEY MIYASATO and ROSITA KAN (jointly, “Plaintiffs”) have filed a First Amended Complaint against you in Civil No. 1CCV-22-0001196, in the Circuit Court of the First Circuit of the State of Hawaii, wherein the Plaintiffs therein pray, among other things, claims for intentional misrepresentation, fraud, breach of covenant of good faith and fair dealing, breach of contract, violation of Haw. Rev. Stat. § 428-409, demand for accounting and constructive trust, arising out of and relating to monies given to Defendant Jeffery Lewis, the real property located at 1751 Algaroba Street, Honolulu, HI 96826, and proceeds from the sale of the property located at 229 Paoakalani Ave. #604, Honolulu, HI 96815 being held on deposit in the First Circuit Court, together with attorneys’ fees, costs and for other proper relief.
YOU ARE HEREBY SUMMONED to be and appear in the courtroom of the Honorable Karin L. Holma, Judge of the above-entitled Court, in her courtroom located at 777 Punchbowl Street, Honolulu, Hawaii 96813 on the 4th day of June, 2024, at 9:00 o’clock a.m., or to file an answer or other pleading and serve it before said day upon Plaintiffs’ attorney, Schlack Ito, a Limited Liability Law Company, whose address is 745 Fort Street, Suite 1500, Honolulu, Hawaii 96813. If you fail to do so, judgment by default will be taken against you for the relief demanded in the First Amended Complaint.
