TO: PACIFIC CRANE SERVICE HAWAII LLC, a Hawaii Limited Liability
Company.
YOU ARE HEREBY NOTIFIED that Plaintiffs TRUSTEES OF THE OPERATING ENGINEERS’ TRUST FUNDS claim that you have violated the terms of PACIFIC CRANE SERVICE HAWAII LLC’s, a Hawaii Limited Liability Company, collective bargaining agreement (“CBA”) with the Operating Engineers Local Union No. 3 of the International Union of Operating Engineers, AFL-CIO, by your refusal to submit timely reports, employee benefit contributions and to allow an audit, in violation of said CBA.
YOU ARE FURTHER NOTIFIED that Plaintiffs TRUSTEES OF OPERATING ENGINEERS’ TRUST FUNDS have filed a Complaint in Civil No. 23-00098-RT-NONE, in the United States District Court For The District of Hawaii, to compel PACIFIC CRANE SERVICE HAWAII LLC’S compliance with the terms of said CBA and for damages against PACIFIC CRANE SERVICE HAWAII, in the amount of $10, 751.56, plus interest at $2.83 from January 25, 2023, until entry of judgment, plus attorney’s fees, costs and additional amounts due, plus interest thereon, that may be uncovered by trial or proof, and for such other and further relief as justice requires.
YOU ARE HEREBY SUMMONED to appear telephonically before the Honorable Rom Trader, 300 Ala Moana Boulevard, Honolulu, Hawaii 96850, on Thursday, August 10, 2023, at 11:00 a.m. Parties and other participants must call-in at least five (5) minutes prior to the scheduled start time of the conference.
