All of that certain LEASEHOLD property containing land area of 5,000 square feet, with a warehouse constructed in or about 1990, having 3,750 sq. ft.. The lease, dated February 14, 1989, recorded in the Bureau of Conveyances of the State of Hawaii, in Liber 22869, at Page 582, has a term of 61 years, ending March 31, 2050. The lease was assigned to Yasuko Hikita, as Trustee, by instrument dated August 21, 2013, recorded in the Bureau as Document No. A-50430194. Commissioner does not have any information regarding the current status of the lease.

Pending Foreclosure: First Circuit Court: Civil No. 1CCV-21-0453; Kawahi & Associates v. Makoa Properties LLC, et. al. (Foreclosure). As of May 31, 2022, the amount due under the loan was $275,518.11, as follows: Principal Balance: $181,658.01; Interest Amount: $69,241.41; Late Charges: $8,241.41; Real Property Taxes: $6,000.00; with additional costs of $10,377.28. Per diem interest of $37.35 per diem at 7.5% per current term after June 1, 2022. Attorney’s fees, litigation expenses and protective advances will also continue to accrue. The information set forth above has been prepared based on tax records, title report, the foreclosure pleadings and information gathered by the Commissioner and is deemed reliable but is not guaranteed. Potential bidders are advised to research public records prior to bidding.

TERMS OF SALE: PROPERTY SOLD IN “AS IS” CONDITION without any warranty of title or other warranty at public auction with 10% highest bid payable in cash, certified check or cashier’s check at close of auction. THERE IS NO UPSET PRICE. Balance of highest bid shall be paid in full upon court approval and confirmation of the sale. Potential bidders must be able to provide proof of ability to comply with the 10% bid requirement BEFORE participating in the public auction. Purchaser shall pay ALL costs of closing, including, but not limited to: costs of conveyance, including preparation of conveyance documents, recordation fees, conveyances taxes, real property taxes, proof of title or title insurance, notary fees, as well as the costs of securing possession of the property. If the subject property is a condominium apartment, Purchaser may also be responsible for some or all unpaid assessments with respect to the apartment pursuant to provisions of Section 514B, HRS, it is Purchaser’s responsibility to determine any such sums due. Purchaser will be required to close by the Court prescribed deadline. Property is vacant, and Purchaser shall be responsible for securing possession of the property. SALE AND TERMS OF THE SALE ARE SUBJECT TO COURT CONFIRMATION. The Commissioner is authorized to close the sale through escrow if requested by the purchaser or the lender.
