NOTICE OF APPLICATION FOR VARIANCE
RECEIVED BY THE DEPARTMENT OF HEALTH
STATE OF HAWAII

BERETANIA STREET SEWER IMPROVEMENTS

Community Noise Control Variance Application No. V-1206
(Docket No. 21-NR-VN-03 )

Pursuant to Chapter 342F-5, subsection (h), Hawaii Revised Statutes, the Department of Health seeks written comments from interested persons regarding the following variance application:

The City and County of Honolulu, Department of Environmental Services (ENV), 650 South King Street, 14th Floor, Honolulu, Hawaii, 96813, has applied to the Department of Health for a noise variance from Hawaii Administrative Rules (HAR), Chapter 11-46-6(a), which states, “General Prohibition. Without a permit or variance issued pursuant to section 11-46-7 or 11-46-8, no person with the State shall operate from any premises or land owned, rented, leased, occupied, or controlled by that person, any excessive noise source.”

ENV proposes to undertake the Beretania Street Sewer Improvements Project in Honolulu, Oahu, Hawaii to maintain the City and County of Honolulu’s wastewater system and provide reliable and continuous service to the affected areas. Based on available information, the existing pipe material, shape, cover, and slope of the sewer mains are substandard. The project involves replacing the existing 10″ sewer line with a 12″ sewer line and installing it at standard depths to meet minimum cover (4 feet).

To complete the work, ENV plans to bypass the sewer line continuously during construction. The sewer bypass may require the use of pumps and generators being ran periodically. Sewer bypass work will require the noise variance permit to cover the hours mentioned below.

The period of construction requested for coverage, pursuant to HAR § 11-46-7(J)(1)(2)(3) includes the following:
Mondays through Fridays: Midnight to 7:00 a.m. and from 6:00 p.m. to midnight
Saturdays: Midnight to 9:00 a.am. and from 6:00 p.m. to midnight
Sundays: Midnight to midnight

Construction activities are anticipated to commence in September 2021 and will continue to July 2022. Residents in the vicinity will be notified of a more detailed schedule prior to the start of construction.

The Department of Health will retain and consider all written comments received not later than thirty (30) days after the date of this notice, on the variance application. The final decision will be made on the basis of the application, related documents, written comments, and the public hearing, if any.
