MAHONEY, DATED NOVEMBER 15, 2004; AND DM KULANA HALE HOLDINGS LLC, DERIVATIVELY ON BEHALF OF KULANA HALE LP; and CAPITOL MARKET, LIMITED (“Plaintiffs”) have filed a Complaint (the “Complaint”) against you in CIVIL NO. 1CCV-21-0000296, wherein Plaintiffs pray for an award of monetary damages and other relief, including, but not limited to, attorney’s fees and costs, as may be warranted, against you in the above-entitled court relating to your contract with Plaintiffs.
YOU ARE HEREBY SUMMONED to appear in the courtroom of the Honorable James H. Ashford, Judge of the above-entitled Court, Ka’ahumanu Hale, 777 Punchbowl Street, Honolulu, Hawaii 96813 on June 22, 2021 at 9:00 A.M., or to file an answer or other pleading and serve it before said day upon Plaintiffs’ counsel, GERALD A. SUMIDA, JOHN P. MANAUT and AVERY C. MATRO, Carlsmith Ball LLP, 1001 Bishop Street, Suite 2100, Honolulu, Hawaii 96813. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint.
