Kaio; Leihaka Kaio; Salu Kaio Tuatonga; Kenneth Kaio; Susan Kaio Johnson; Lisa Kaio Foki; Nova Joy Kaio; Jason Kaio (the individual plaintiffs named above are hereinafter collectively referred to as “Kaio Family Plaintiffs”) (BYUH, the Kaio LLC, and Kaio Family Plaintiffs are collectively referred to as “Plaintiffs”), filed a First Amended Complaint (“Complaint”) in the Circuit Court of the First Circuit, State of Hawaii, in Civil No. 16-1-2335-12, wherein Plaintiffs pray that the Court quiet title and partition by sale certain real property located in Laie, Hawaii, and identified by the following Tax Map Key (“TMK”) Numbers:
Tax Map Key No. (1) 5-5-8-9, being Apana 1, containing an area of .16 acre
(“Poohaili Parcel 9”);
Tax Map Key No. (1) 5-5-8-40, being Apana 2, containing an area of .58 acre
(“Poohaili Parcel 40”); and
Tax Map Key No. (1) 5-5-8-2, being Apana 4, containing an area of .1 acre
(“Poohaili Parcel 2”).
Tax Map Key No. (1) 5-5-5-2, being Apana 5, containing an area of .64 acre
(“Campus Parcel 2”);
Tax Map Key No. (1) 5-5-5-13, being Apana 6, containing an area of .25 acre
(“Campus Parcel 13”);
YOU ARE HEREBY SUMMONED TO APPEAR in the courtroom of the Honorable James H. Ashford, Judge of the above-entitled Court, on Tuesday, the 9 day of March, 2021, at 9:00 o’clock a.m., at 777 Punchbowl Street, Honolulu, Hawaii 96813, or to file with the Court an answer or other pleading in response to the Complaint and serve it before said date upon DAVID A. IMANAKA, ESQ. of Bays Lung Rose & Voss, attorneys for Plaintiff whose mailing address is Topa Financial Center, 700 Bishop Street, Suite 900, Honolulu, Hawaii 96813. Unless you so appear or file a responsive pleading as indicated above, before the time indicated above, your default may be taken and the Complaint may be taken as admitted, and a judgment by default may be taken against you for the relief demanded in the Complaint.
