NOTICE SETTING DATE, TIME, AND PLACE OF HEARING ON PLAINITFF’S MOTION FOR DEFAULT JUDGMENT

TO: HEIRS AND ASSIGNS OF HAKUAIKAWAI (w) and the heirs, assigns and devisees of such persons who are deceased, or persons holding under said Heirs, and spouses, assigns, successors, personal representatives, executors, administrators, and trustees of such persons who are deceased, and all other unknown persons or entities claiming any right, title, estate, lien or interest in the real property described below.

YOU ARE HEREBY NOTIFIED that Plaintiff TRUSTEES OF QUEEN LILI’UOKALANI TRUST claim fee simple ownership to the land described as:

All of that certain parcel of land (being a portion of the land(s) described in and covered by Royal Patent Number 2516, Land Commission Award Number 1741, to Keawe no Hakuaikawai) situate, lying and being at Kapalama, Honolulu, City and County of Honolulu, State of Hawai’i, being LOT 8 of the “AUYONG SUBDIVISION”.

YOU ARE HEREBY FURTHER NOTIFIED that Plaintiff has filed a Motion for Default Judgment; Memorandum in Support of Motion; Declaration of Nathan T. K. Aipa; Exhibits “A” to “T”; Notice Setting Date, Time, and Place of Hearing Motion and Certificate of Service in First Circuit Court, State of Hawaii, in Civil No. 19-1-1534-09 JPC requesting that a judgment be entered holding that Plaintiff is the sole and exclusive owner of the above-mentioned property and that title to said property is vested in Plaintiff.

YOU ARE HEREBY FURTHER NOTIFIED that Plaintiff’s Motion will be heard in the courtroom of the HONORABLE JEFFREY P. CRABTREE, Judge of the above-entitled Court, Kaahumanu Hale, 777 Punchbowl Street, Honolulu, Hawaii, on Wednesday, the 9th day of September, 2020, at 9:00 o’clock a.m. Pursuant to Rule 56 and 58 of the Hawaii Rules of Civil Procedure, you have not less than eight (8) days before the date set for hearing to file a response or other pleading and serve it before said day upon Plaintiff’s counsel, Nathan T. K. Aipa, Pitluck Kido & Aipa, LLP, Dillingham Transportation Building, 701 Bishop Street, Honolulu, Hawaii 96813, to show cause, if you have any, why the Motion for Default Judgment should not be granted. Unless you file a response or other pleading before the time aforesaid or appear in the above-entitled Court at the time and place aforesaid, the judgment will be entered and title to the above-mentioned property will be vested in Plaintiff.
