YOU ARE HEREBY NOTIFIED that Plaintiff KAKAAKO LAND COMPANY, LLC claims fee simple ownership to the land described as:
All of that certain parcel of land, (portion of the land described in Royal Patent No. 5716, Land Commission Award 10605 to Kamakee to Piikoi) situate at Kewalo, Honolulu, City and County of Honolulu, State of Hawaii.
By Deed dated September 15, 1896, recorded in the Bureau of Conveyances of the State of Hawaii in Liber 164, Page 255, from Lydia K. Davis (nee Cummins) an unmarried woman, Elizabeth K. Fairchild (nee Cummins), wife of George H. Fairchild, and Maria K. King (nee Cummins), wife of Steven G. O. King to Charles S. Desky, Trustee, and more particularly described as follows:
Commencing at the East corner of Mrs. C. P. Ward’s property on the lower end of King Street, at angle of fence, and running south 29° and 20° West true 2050 feet along fence between Mrs. Ward’s and Kewalo of M. M. Piikoi to angle of fence at South corner of Mrs. Ward’s property; thence South 38° 08° east, true, along the Grant to Grant 1944 to E. W. Clark in Kukuluaeo, and boundary of Kewalo to King Street, and along King Street to the initial point.
Containing approximately sixty-five (65) acres.
YOU ARE HEREBY FURTHER NOTIFIED that Plaintiff has filed a Complaint To Quiet Title in the First Circuit Court, State of Hawaii, requesting that title to the above-described real property be determined as to any and all adverse claims not presented and/or adjudicated in this action.
YOU ARE HEREBY SUMMONED to appear in the courtroom of the HONORABLE JEFFREY P. CRABTREE, Judge of the above-entitled Court, 777 Punchbowl Street, Honolulu, Hawaii, on Tuesday, the 30th day of June 2020, at 9:00 o’clock a.m., or to file an answer or other pleading and serve it before said day upon Plaintiff’s counsel, Jonathan L. Ortiz, Ortiz & Associates, Davies Pacific Center, Suite 2121, 841 Bishop Street, Honolulu, Hawaii 96813, to show cause if you have any, why the prayer of said Complaint To Quiet Title should not be granted. Unless you file an answer before the time aforesaid or appear in the First Circuit Court, State of Hawaii, at the time and place aforesaid, your default will be recorded, and said Complaint To Quiet Title will be taken as confessed and a judgment by default will be taken against you for the relief demanded in the Complaint To Quiet Title.
