NOTICE OF INTENT TO FORECLOSE LIENS AND SALE BY PUBLIC AUCTION

NOTICE IS HEREBY GIVEN, pursuant to: (1) the Declaration of Covenants, Conditions and Restrictions for Interval Ownership within the LIFETIME IN HAWAII INTERVAL OWNERS ASSOCIATION and the Bylaws attached thereto filed for the record in the Office of the Assistant Registrar of the Land Court of the State of Hawaii (herein the “Land Court”) as Document No. 1269356 (herein collectively the “Declaration”); (2) The Notice of Liens and Intent to Foreclose and Sale by Public Auction filed with the Bureau of Conveyances as Document No. A-69550702 and (3) Sections 667-2 through 667-5 H.R.S. that a secured lien exists for failure to pay duly assessed maintenance and/or special assessments pursuant to the Declaration and will be foreclosed upon by Lifetime in Hawaii Interval Owners Association (herein “Lifetime”) against each of the following intervals in an amount equal to the stated delinquency amount plus accrues, interest and costs of enforcement including attorney fees, by sale of the stated units at a public auction. The auction will be held near Queen Liliuokalani statute on the back steps of the State Capitol Building, 415 S. Beretania Street, Honolulu, Hawaii 96813 at 12:00 Noon, Friday, April 26, 2019.

Each of the units to be foreclosed is a time share interest in the Royal Kuhio Condominium Project, located at 2240 Kuhio Avenue, Honolulu, Hawaii (herein the “Project”), consisting of: (a) an undivided 1/51 interest in the listed apartment unit for each use week; (b) an undivided interest in the common elements (exclusive of the land) of the Project; (c) the exclusive right each use year to occupy and use an interval in said apartment unit as set forth below.

At the foreclosure sale, each unit shall be sold separately, in and “AS IS” condition, with no upset price, to the highest bidder with not less than twenty-five percent (25%) of the highest bid price payable as a non-refundable deposit in cash (U.S.) or cashier’s check at the close of the auction; with balance payable upon delivery of documents conveying title. Purchaser shall pay all costs of conveyancing, including any title insurance and escrow fees, conveyance taxes, document drafting and preparation, securing possession, and notary and recording fees. Any foreclosure sale is subject to postponement and/or cancellation for any reason before or after commencement of bidding, at Lifetime’s sole discretion.

After the foreclosure sale by public auction has been duly completed, Lifetime shall file for the record with the Land Court an Affidavit of Exercise of Power of Sale pursuant to the Declaration and Hawaii Revised Statutes Section 667-62. Title to the units sold at the foreclosure sale shall thereafter by conveyed to the respective purchasers by Interval Warranty Deed and Lease executed by LIFETIME, as “Seller” (pursuant to the power of sale provisions of the Declaration and 667-62 H.R.S.), and the relevant purchaser, as “Purchaser”.
