YOU ARE HEREBY NOTIFIED that Plaintiff CHRISTOPHER BARRY TURNER has filed a Motion to Compel Arbitration; Memorandum in Support of Motion; Declaration of Sherman Shiraishi; Exhibits "A" – "G"; Notice of Motion against you in Civil No. 18-1-0127, in the Circuit Court of the Fifth Circuit, State of Hawaii, wherein Plaintiff prays for entry of an Order compelling you to arbitrate Plaintiff’s claim that you are required to give your written consent to allow Plaintiff to obtain permits and related documents from the County of Kauai that are necessary for Plaintiff to improve his real property in the Kealia Kai 27 condominium property regime, and for costs, attorneys’ fees, and other proper relief.
YOU ARE HEREBY SUMMONED to appear and THIRD AMENDED NOTICE IS HEREBY GIVEN that Plaintiff’s Motion to Compel Arbitration shall come on for hearing before the Honorable Randal G.B.
