No upset price. The property will be sold at public auction in "as is" condition without any warranties as to title or possession and subject to possible prior liens of record. The successful bidder shall pay 10% of bid by cash, cashier’s or certified check at close of auction and the balance of purchase price upon court approval and confirmation of sale and tender of title. Potential bidders must provide proof of ability to comply with 10% of bid requirement prior to participating in the auction. At the Court’s discretion, the 10% down payment may be forfeited in full or in part if the buyer fails to pay the balance of the purchase price. Buyer will pay for all costs of closing including escrow fees, conveyance documents, conveyance and real property taxes, recordation fees, and will be responsible for securing possession of the property. Neither title insurance nor securing possession of the property shall be a condition of closing. SALE IS SUBJECT TO COURT CONFIRMATION.
