YOU ARE HEREBY NOTIFIED that Plaintiff INVESTORS FUNDING CORPORATION, as Trustee for an unrecorded Loan Participation Agreement dated October 1, 2015 (hereafter referred to as “Plaintiff”) has filed a Complaint against you in Civil No. 17-1-0207-02, in the Circuit Court of the First Circuit, State of Hawaii, seeking a judgment and to collect the principal amount of $265,000.00, together with interest of $20,256.16 to January 24, 2017, and accruing interest thereafter, late fees of $1,950.00, and reasonable attorneys’ fees and costs in connection with the collection of that certain Interest Only Note dated October 7, 2015. Plaintiff is also seeking to foreclose its related Mortgage, Security Agreement And Financing Statement and enforce its Assignment of Lessor’s Interest In Leases And Rents both dated October 7, 2015, on that certain real property located at 411 Hobron Lane, Apartment No. 3204, Honolulu, Hawaii 96815, and identified by Tax Map Key No. (1) 2-6-012-029, CPR No. 0353.
YOU ARE HEREBY SUMMONED to appear in the courtroom of the Honorable Jeannette H. Castagnetti, Circuit Court, First Circuit, Kaahumanu Hale, 777 Punchbowl Street, 4th Floor, Honolulu, Hawaii, on October 2, 2018, at 9:00 o’clock a.m., or to file an answer or other pleading and serve it before said day upon Plaintiff’s attorney, Cori Ann C. Takamiya, Kessner Umebayashi Bain & Matsunaga, whose address is 220 South King Street, Suite 1900, Honolulu, Hawaii 96813. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint.
