NON-JUDICIAL FORECLOSURE
UNDER POWER OF SALE
Association of Apartment Owners of Makaha Valley Plantation (“Association”), as Lienholder, under and pursuant to Section 514B-146(a), HRS, as amended, and Part VI of Chapter 667, HRS, as amended, gives notice that the Association will hold a sale by public auction.
Auction Date: August 20, 2018 at 12:00 p.m.
Auction Location: State Capitol Building, 415 S. Beretania Street, Honolulu, Hawaii 96813 (rotunda area on the steps leading down to the Queen Liliuokalani Statue).
Property: The fee simple property located at 84-688 Ala Mahiku Street, Apt. 166A, Waianae, Hawaii 96792, being Tax Map Key No. (1) 8-4-002-049, CPR No. 0484.
Owner: PANSY LEIMAMO OHELO-PITOLO.
Other Creditors: U.S. Bank National Association; U.S. Bank National Association, as Trustee for the Registered Holders of Asset-Backed Pass-Through Certificates Series 2006-HE3. This information is not guaranteed. Bidders should perform their own due diligence.

Terms of Sale: (1) no upset price; (2) Property sold strictly in an “AS IS” and “WHERE IS” condition and SUBJECT TO any prior liens and/or outstanding real property taxes; (3) Property sold without warranty of title, express or implied, and upon information and belief, Property has encumbrances; (4) Purchaser must pay at least 10% of the winning bid in cash or by certified/cashier’s check at close of auction, and must show proof of funds prior to bidding; (5) Association may credit bid; (6) Property will be conveyed by quitclaim conveyance upon payment by Purchaser of all costs related to sale, including, but not limited to, costs of drafting conveyance document, notary fees, consent fees, escrow fees, conveyances taxes, and recording fees; (7) title insurance is Purchaser’s sole responsibility, however, ability to procure insurance shall not be a condition of closing; (8) securing possession is Purchaser’s sole responsibility; (9) if Purchaser fails to comply with the terms and conditions of the public sale, or fails to complete the purchase within forty-five (45) days after the date of the public sale, the down payment shall be forfeited pursuant to Section 667-99, HRS; and (10) the auction may be postponed or canceled by the Association pursuant to Section 667-97, HRS.
THE DEFAULT UNDER THE ASSOCIATION DOCUMENTS MAY BE CURED NO LATER THAN THREE (3) BUSINESS DAYS BEFORE THE DATE OF THE PUBLIC SALE OF THE UNIT BY PAYING THE ENTIRE AMOUNT THAT WOULD BE OWED TO THE ASSOCIATION PLUS THE ASSOCIATION’S ATTORNEY’S FEES AND COSTS, AND ALL OTHER FEES AND COSTS INCURRED BY THE FORECLOSING ASSOCIATION RELATED TO THE DEFAULT, UNLESS OTHERWISE AGREED TO BETWEEN THE ASSOCIATION AND THE UNIT OWNER. IF THE DEFAULT IS SO CURED, THE PUBLIC SALE SHALL BE CANCELED.
THE CURRENT OWNER SHALL HAVE ONE (1) YEAR FROM THE DATE THE ASSOCIATION RECORDS A DEED TO REDEEM THE PROPERTY BY PAYING THE FULL AMOUNT OF THE OWNER’S DELINQUENCY TO THE ASSOCIATION.
