NOTICE OF EXECUTION SALE
IN THE CIRCUIT COURT OF THE FIRST CIRCUIT, STATE OF HAWAII
BENJAMIN PAUL KEKONA, et al. v. PAZ FENG ABASTILLAS, et al.
CIVIL NO. 93-3974-10 (JHA)

Under and by virtue of the ORDER GRANTING PLAINTIFF TAMAE M. KEKONA, INDIVIDUALLY AND AS PERSONAL REPRESENTATIVE OF THE ESTATE OF BENJAMIN PAUL KEKONA’S MOTION FOR WRIT OF EXECUTION AGAINST CERTAIN REAL PROPERTY OWNED BY DEFENDANTS PAZ FENG ABASTILLAS AND ROBERT A. SMITH (filed Nov. 16, 2017) issued out of the above-entitled cause on February 8, 2018, I will offer for sale at public auction to the highest bidder, at the Circuit Court of the First Circuit, Kaahumanu Hale, 777 Punchbowl Street, Ewa lanai on First Floor, Honolulu, Hawaii 96813 on Thursday, March 29, 2018, at the hour of 12 o’clock noon, all of the right, title and interest of Paz Feng Abastillas and Robert A. Smith in and to that certain real property located at 47-186 Kamehameha Highway, Kaneohe, Hawaii 96744; TMK: (1) 4-7-035-007, consisting of 11,994 sq. ft., more or less, or so much thereof as may be found necessary to satisfy that certain Third Amended Final Revised Judgment dated September 16, 2016 entered in this case in favor of Plaintiffs, and against Defendant Paz Feng Abastillas for $2,624,191, and against Defendant Robert A. Smith for $1,784,689, plus interest, costs, attorneys fees, and sheriff’s fees and expenses. I reserve the right to reject all bids. Ten percent (10%) of the bid price for the sale shall be payable in cash in United States legal tender at the fall of the hammer, payable to the Law Offices of Fred Paul Benco, and the balance due by no later than the date of Court confirmation of the sale and the delivery of the Sheriff’s Deed; buyer or buyers shall take delivery on that date at buyer’s or buyers’ sole cost and expense. In the event the successful bidder fails to close by the indicated date, said bidder will forfeit the deposit. In lieu of cash in United States tender or certified check, Plaintiffs above-named may bid the value of the Judgment(s) and any interest thereon at the time of sale, and also use said value as good consideration for the down-payment required above. The property will be sold "AS IS" subject to liens and encumbrances thereof, if any, and there shall be NO WARRANTY OF TITLE, express or implied.
