NOTICE OF PROPOSED WATER POLLUTION CONTROL PERMIT FOR THE REHABILITATION OF KAMEHAMEHA HIGHWAY, UNIT 73B PROJECT

The State Department of Health (DOH) tentatively proposes to issue a National Pollutant Discharge Elimination System (NPDES) permit to discharge storm water associated with construction activity from the Rehabilitation of Kamehameha Highway, Unit 73B Project, to receiving State waters, subject to special conditions to:

The proposed permit for the new discharge will expire five (5) years from the date of issuance.

The project site is located along various streets in Kaneohe (Kamehameha Highway between Heeia Harbor and Haiku Road, various streets near Kaneohe Bay Drive between Moakaka Place and Paku Place) on the Island of Oahu, Hawaii, TMKs: (1) 4-4-007, 012, 013, 014, 015, 017, 021, 022, 037; (1) 4-5-031, 100, 101; (1) 4-6-004, 005, 006, 007, 008, 016, 018, 019, 020, 021, 022, 033. The project involves reconstructing the concrete curb and gutter, curb ramp, concrete bus pad, asphalt roadway, traffic loops, signage, thermoplastic striping, and adjustment of utility manholes. No stockpiling is planned for this project.

The receiving water, Kaneohe Bay (South Region, Central Region, and Kokokahi Pier), is classified by the DOH as Class AA, Marine Waters. Under Hawaii Administrative Rules (HAR), the objective of Class AA waters is for these waters to remain in their natural pristine state as nearly as possible with an absolute minimum of pollution or alteration of water quality from any human caused source or actions. To the extent possible, the wilderness character of these areas shall be protected.

The receiving water, Kawa Stream, is classified by the DOH as Class 2, Inland Waters. The objective of Class 2 waters is to protect their use for recreational purposes, the support and propagation of aquatic life, agricultural and industrial water supplies, shipping, and navigation. The uses to be protected in this class of waters are all uses compatible with the protection and propagation of fish, shellfish, and wildlife, and with recreation in and on these waters.

Persons wishing to comment upon or object to the proposed NPDES permit or to request a public hearing, should submit their comments or requests in writing no later than 30 calendar days after the date of this notice, either through E-mail at cleanwaterbranch@doh.hawaii.gov or by mail at P. O. BOX 3378, Honolulu, HI 96801 3378.

Copies of the proposed public notice permit and other information are available for public inspection, Monday through Friday (excluding holidays) from 7:45 a.m. until 4:15 p.m., at the DOH Clean Water Branch office located at the Hale Ola Building, Room 225, 2827 Waimano Home Road, Pearl City, HI 96782. All written comments and requests received on time will be considered. If DOH determines that there is significant public interest, a public hearing may be held after at least 30 calendar days of public notice.

If DOH’s position is substantially unchanged after considering all timely written comments and all oral comments at any public hearing that may be held, then the DOH will issue the NPDES permit and this action will be final.
