NOTICE OF FORECLOSURE SALE

Deutsche Bank National Trust Company vs. Edward W. Andersen et al.- Civil No. 15-1-0444-03, 1196 Punua Place, Kailua, Hawaii (FEE SIMPLE), one story-single wall – single family dwelling w/3 BEDROOM/2.5 BATH & 2 CAR CARPORT – Tax Map Key (1) 4-2-028-064-0000. OPEN FOR INSPECTION SUNDAYS JANUARY 21, 2018 & JANUARY 28, 2018 – 1:00 PM to 5:00 PM, AUCTION DATE: 12:00 NOON – WEDNESDAY FEBRUARY 14, 2018 – Ewa Plaza of Ka’ahumanu Hale, 777 Punchbowl Street, Honolulu, Hawaii. TERMS OF SALE: NO UPSET PRICE. The Property which is in very poor condition as the result of storm damage, will be sold in "AS IS" condition, without any representations or warranties whatsoever as to the condition of the Property or title or possession, by way of Commissioner’s quitclaim conveyance per Order of the Court. The successful bidder at the auction must make a down payment to Commissioner of not less than 10% of the highest successful bid price, in cash, money order, cashier’s check or certified check drawn on a financial institution acceptable to Commissioner in his sole discretion. Prior to bidding, each prospective bidder must register with the Commissioner and establish to Commissioner’s satisfaction that the prospective bidder has the ability to make the required down payment, in the required form, immediately upon closure of the bidding, except the Plaintiff/Mortgagee who may "credit-bid" up to the amount of its encumbrance. At the Court’s discretion, the ten percent (10%) deposit may be subject to forfeiture in full or in part if the successful bidder/Purchaser fails to pay the balance of the purchase price when due. At the confirmation hearing the Court will allow reopening of the auction and consider additional bids, the first of which must be at least five percent (5%) greater than the highest bid at the public auction. The balance of the purchase price shall be paid to the Commissioner upon conveyance of the Property by Commissioner, provided that if the Plaintiff/Mortgagee is the purchaser, the purchaser may satisfy the balance of the purchase price by way of offset up to the amount of its secured debt. All costs and expenses of the closing, including, without limitation, cost of conveyance, preparation of conveyance documents, conveyance tax, escrow and recording fees, any proof of title or title insurance, and notary fees, as well as the cost of securing possession of the Property, which is occupied by Mortgagor, shall be the responsibility of and paid by the purchaser. There will be no permitted bidder/purchaser contingencies or conditions to the sale including, but not limited to, property inspection, financing the purchase, the availability of title insurance or securing possession of the Property.
