AMENDED NOTICE OF SALE

Under and by virtue of the Writ of Execution issued out of the above-entitled cause, I have levied upon and will offer for sale at public auction to the highest bidder, at the Circuit Court of the First Circuit, Ka’ahumanu Hale, 777 Punchbowl Street, Honolulu, HI 96813, on July 25, 2018, at the hour of 12 o’clock noon, all interest of the estate of the above-named Plaintiff JUNE T. AOYAGI ("Plaintiff") in the property located at 589 Kipuka Place, Kailua, HI 96734, TMK: (1) 4-3-060-027, or so much thereof as may be found necessary to satisfy the Judgment entered herein against Plaintiff on May 30, 2017, plus interest, costs, attorneys’ fees, and the process server’s costs, expenses, and commissions. I reserve the right to reject all bids.
Ten percent (10%) of the bid price shall be payable in cash in United States legal tender or certified check on the fall of the hammer, payable to Damon Key Leong Kupchak Hastert, and the balance by no later than seven (7) days after the Court issues an Order Granting Motion to Confirm Execution Sale; buyer or buyers shall take delivery on day of sale at buyer’s or buyers’ sole cost and expense. In the event the successful bidder fails to close by the indicated date, said bidder will forfeit deposit. In lieu of cash in a United States tender or certified check, Defendants ESTATE OF CINDY HATSUE AOYAGI and GLENN YOSHIO OTA, individually and as Personal Representative of the Estate of Janis Yukie Ota, may bid the value of their Judgment at the time of sale.
The property will be sold "AS IS" subject to all liens and encumbrances thereof, if any, and there shall be no warranty of title, express or implied. Only the right, title, and interest of Plaintiff is to be sold.
