Rosehill Ching et al., Civil No. 06-1-1976-11 (KKH) (Consolidated) NOTICE OF EXECUTION SALE Under and by virtue of the Fifth Alias Writ of Execution filed May 15, 2017 and all subsequent Alias Writs of Execution, which were issued out of the above-entitled consolidated cases, I have levied upon and will offer for sale at public auction to the highest bidder, at the Circuit Court of the First Circuit, Kaahumanu Hale, 777 Punchbowl Street, Honolulu, Hawaii, 96813, on October 23, 2017, at the hour of 12 o’clock noon, Defendant Marcus D.E. Rosehill’s one-third (1/3) ownership interest in the real property described in Exhibit "A" to satisfy the Final Judgment In Favor of Plaintiffs Jim Andrews and The Landscape Works, Inc. Against Defendant Marcus Rosehill, Individually, entered in the above-entitled case on September 1, 2011 ("Final Judgment") in the principal amount of $2,500,000.00, plus interest, costs, attorney’s fees and sheriff’s fees and expenses. Exhibit "A" includes TMK Number: (1) 4-6-001-023-0000, which is located at 46-089 Lilipuna Road, Kaneohe, Hawaii, 96744. Ten percent (10%) of the bid price shall be payable in cash in United States legal tender or certified check on the fall of the hammer, payable to RYAN G. S. AU, AAL, LLLC, and the balance shall be paid upon delivery of the Certificate of Purchase; buyer or buyers shall take delivery on day of sale at buyer’s or buyers’ sole cost and expense. In the event the successful bidder fails to close by the indicated date, said bidder will forfeit deposit. In lieu of cash in United States tender or certified check, Plaintiffs Jim Andrews and The Landscape Works, Inc. may bid the value of his Final Judgment at the time of sale. Plaintiffs Jim Andrews and The Landscape Works, Inc. reserve the right to obtain the Circuit Court’s approval and confirmation of the sale and application of the proceeds. I reserve the right to reject all bids. Defendant Marcus D. E. Rosehill’s one-third (1/3) interest in the real property will be sold "AS IS" subject to all liens and encumbrances thereof, if any, and there shall be no warranty of title, express or implied. Only Defendant Marcus D. E. Rosehill’s one-third (1/3) interest of his right, title, and interest to the real property described in Exhibit "A" is to be sold. For further information, call DENNIS H.
